Terms of Service

These Terms of Service (“Terms”) govern your access to and use of ETF Setups (the “Service”), operated by ETF Setups (“we,” “us,” or “our”), available at etfsetups.com. By creating an account, subscribing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What ETF Setups Is — and Is Not

ETF Setups publishes a rules-based, systematic research process: market-regime readings, sector and stock signals, model trade levels, and a transparent track record of the system’s outputs. It is an educational and informational research tool.

ETF Setups is not financial, investment, tax, or legal advice. We are not a registered investment adviser, broker-dealer, or financial planner, and nothing on the Service is personalized to your financial situation, objectives, or risk tolerance. We do not manage money, place trades, or recommend that any specific person buy or sell any specific security. Every trading and investment decision you make is your own.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements and that the information you provide is accurate.

3. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Accounts are for a single user. You may not share, resell, or redistribute access, signals, levels, or other content. We may suspend or terminate accounts that share credentials or that scrape, copy, or redistribute the content.

4. Subscriptions, Billing, and Cancellation

  • Billing. Membership is $99 per month, billed in advance on a recurring basis to your payment method until cancelled. By subscribing you authorize us and our payment processor to charge the applicable fee each billing period.
  • Cancellation. You may cancel at any time from your account. Cancellation stops future renewals; you keep access through the end of the billing period you have already paid for.
  • No refunds. Payments are non-refundable, including for partial periods. We provide a free guide and a public track record so you can evaluate the Service before subscribing.
  • Price changes. We may change subscription pricing on a going-forward basis with reasonable notice; changes do not affect a period you have already paid for.

Payments are processed by Stripe. We do not store your full card details.

5. Acceptable Use

You agree not to: (a) copy, scrape, republish, resell, or redistribute any content; (b) share your account or access with others; (c) use automated means to access the Service beyond normal personal use; (d) reverse engineer or attempt to derive the underlying parameters of the system; or (e) use the Service for any unlawful purpose.

6. Intellectual Property

All content, signals, methodology descriptions, software, and materials on the Service are owned by us or our licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to access the content for your own individual use. No other rights are granted.

7. Trading Risk Disclosure

Trading and investing in securities, ETFs, and equities involves substantial risk of loss and is not suitable for every investor. You can lose some or all of your capital. Past performance, including any backtested or historical results shown, is not indicative of and does not guarantee future results. Hypothetical or model results have inherent limitations and may differ materially from actual trading. You are solely responsible for evaluating the risks of any decision and for your own trading.

8. No Guarantees

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that signals will be profitable, that data will be error-free or uninterrupted, or that the Service will meet your expectations.

9. Limitation of Liability

To the maximum extent permitted by law, we and our owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any trading losses, lost profits, or lost data, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the three (3) months before the claim arose.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or expenses arising out of your use of the Service, your trading decisions, or your violation of these Terms.

11. Changes to the Service and These Terms

We may modify or discontinue any part of the Service at any time. We may update these Terms; the “Last updated” date reflects the latest version, and your continued use after changes constitutes acceptance.

12. Termination

We may suspend or terminate your access at any time for violation of these Terms or for any conduct we reasonably believe is harmful to the Service or to other users.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in the State of California.
